A company out of [REDACTED] (temporary fencing) that are meant to protect the public from being injured or killed around job-sites, pools, trenches, lakes, waterways, and other hazardous areas. However their design is aimed at reducing costs in lieu of public safety. Currently ASTM F 3342-19 does not define what is considered safe. Instead it ASTM F 3342-19 Section 1.6 states in part:
1.6 – This standard does not purport to address all of the safety concerns, if any, associated with its use. It is the responsibility of the user of this standard to establish appropriate safety, health, and environmental practices and determine the applicability of regulatory limitations prior to use. In other words leaving the definition of a safe fence up to BOCA.
Rental companies and contractors are unknowingly purchasing safety products and installing them in hazardous locations with the presumption that they have been tested to be safe. Master Halco, the largest manufacturer and distributor of fence systems in the USA, has taken it a step further, buy actually advertising that the product is safe. However when I spoke to Master Halco’s legal department disclaimed the product as being safe in areas in-which it was not originally intended – hazardous areas. Injuries and deaths have occurred in connection with safety fences that did not meet BOCA. [REDACTED]
